Supreme Court of Canada Gives First Nations the Right to Refuse Development on their Lands

In Canada,governments and companies are required to consult with the aboriginal population when developing projects such as mining or pipelines on their land. Now they have to have consent.

Tsilhqot'in First Nation

A few days ago, in the first ruling of its kind, the Supreme Court of Canada granted the Tsilhgot'in first nation title to more than 1,700 square kilometers of land in Northern British Columbia. The nation reclaimed its right to hunt , fish and trade in traditional territory,rather than specific settlement sites as was the original agreement. Recognizing the semi - nomadic nature of First nations, the court ruled that aboriginals have the right to claim traditional hunting grounds even if they are used only sporadically.

Moreover, in addition to consulting with First Nations Governments and Companies must obtain consent for any development on their land.


" It only took 150 years, but we look forward to a much brighter future. This without question will establish a solid platform for genuine reconciliation to take place in British Columbia" ( Grand Chief Stewart Phillip, president of Union of B.C. Indian Chiefs)

Implications and Opinions

The government can allow development on aboriginal lands if it is seen as in the best interests of the people. However any development must be proved to be pressing and substantial.
This ruling may be the end of the Northern Gateway Pipeline as well as many other pipelines and mining developments. Those who persist may find themselves in long and expensive battles with the courts.

As an environmentalist I am very encouraged by this ruling and am encouraged to know that, as yet, Harper does not control the courts.

I am waiting for the next election, as the other two parties are against the pipeline, If Enbridge does not back out now they will be embroiled in the court till the government changes a year from now. I don't think they have a hope with 80% of the population of B.C. against it.

Antonia Mills, a First Nations professor at the university of northern B.C. states:
"The pipeline is going through many, many,First nations who have already declared that they do not want the Enbridge Pipeline going through their territories, and this decision strengthens their rights to preserve their traditional territories"

This decision sets a precedent for rulings concerning aboriginal lands and the development of those lands .It gives aboriginal people some legal power. We can expect to see many more successful land claims and legal actions to protect the environment across Canada.

This may be the opening needed for the ancient Hopi prophesy to begin to be fulfilled.

Great job C. D. So glad you wrote about this. Of course Harper will undoubtedly pull out all the stops to try to skirt around this ruling. On the other hand, perhaps the tide is indeed turning.

Thank you Steve. I checked to see if you had written about it but perhaps the powers that be do not want Americans to know.Had you heard anything about it down there?
Harper is losing favour, even with those in his own party. It's just a matter of time I hope Of course he could conceivably, rig the election.But now there is hope!

I hope it applies underground as well as on the surface.

I believe fracking is causing earthquakes to increase dramatically over their in America.

This is a good beginning. The indigenous peoples must be treated in civilized manner. Some people walked into your lands and then they start to fight for independence. Do I need to elaborate? Do you know why the indigenous races must shift further and further into the jumgles?

With the ruling, anger which have been worn by the aboriginals on their faces for centuries would change to laughter and happiness. At last a birthright that had been denied them for so long has been restored. Keep up!
